Compliance with Speed Limits, Pedestrians, Cyclists and Equestrians Rights 

Dear Homeowners, 

I hope this message finds you well. As we continue to prioritize safety and respect within our community, I would like to kindly remind all residents and visitors of the importance of adhering to speed limits, particularly in areas where pedestrians, cyclists and equestrians may be present. 

Arizona Revised Statute §28-735 outlines the rights of equestrians on roadways and within communities, emphasizing the need for mutual respect and caution. This statute states: 

“A person riding an animal or driving an animal-drawn vehicle on a roadway is granted all of the rights and is subject to all of the duties that are applicable to the driver of a vehicle by this chapter and chapters 4 and 5 of this title, except special rules in this article and except provisions of this chapter and chapters 4 and 5 of this title that by their nature can have no application.” 

Violating this statute can result in penalties, including fines and potential legal action. 

It’s imperative that all members of our community, whether on foot, bicycle, or horseback, feel safe and respected. Therefore, I urge all homeowners and guests to be vigilant of their speed and to exercise patience and awareness, especially when sharing the roads with equestrians. Please slow down when you encounter people walking, riding bicycles, and riding horses. Additionally, if you witness any vehicles violating speed limits or endangering pedestrians, equestrians, or cyclists, feel free to contact the Sheriff’s office with vehicle descriptions and license plate numbers. 

Let’s work together to create a harmonious environment where everyone’s rights are upheld, and safety is paramount.

Burn Permits

Am I allowed to burn on my Parcel?  While the CC&R’s are clear that “No outdoor burning of rubbish shall be permitted on any Parcel, we must determine what is rubbish. Rubbish is a word of British origin for waste material; refuse or litter.

Section 5, Paragraph L, Page 9: Garbage and Refuse Disposal. No Parcel shall be used or maintained as a dumping ground for rubbish or hazardous or toxic waste or materials. Trash, garbage, or other waste shall not be kept except in sanitary containers. All containers for the storage of such material shall be kept in a clean and sanitary condition. No outdoor burning of rubbish shall be permitted on any Parcel. The regular removal of garbage and refuse is the Parcel Owner’s responsibility.

Since the CC&R’s do not clearly define what exactly rubbish is, the community must look to a higher power for clarity of the matter. Yavapai County defines when, what, and how one can burn on their parcel. Because of this, the Board has elected to default to Yavapai County standards for our community.

All AMPOA property owner’s and/or their renter’s if applicable, MUST obtain a Yavapai County Burn Permit prior to burning. They MUST also comply with ALL of their Burn Permit requirements.

Failure to comply with this request and the governing documents may result in fines, legal action, or other enforcement measures as outlined in our governing documents.
